USER AGREEMENT

PLEASE READ THESE TERMS CAREFULLY. Your use of this website (“Site”) is conditioned upon your complete acceptance of this agreement. By accessing or using the Site, you agree to be legally bound by this User Agreement and all incorporated rules, policies, and terms (collectively, the “Agreement”). If you do not agree to these terms, do not use this Site.

1. Scope and Acceptance

This Agreement applies exclusively to your access and use of the Site hosted on behalf of Faith & Family Realty (referred to as the “Company,” “we,” “us,” or “our”). Any user who accesses the Site is a “User.”

Changes to the Agreement: We reserve the right to change or modify this Agreement and the Site at any time. Any revisions will be effective immediately upon posting the new version on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Agreement. If you do not agree to the amended terms, you must immediately stop using the Site.
Legal Capacity: The Site is not intended or authorized for use by persons under the age of eighteen (18). By using the Site, you confirm you are 18 years of age or older and agree to be legally bound by this Agreement.
Entity Representation: If you use the Site on behalf of any business or entity, you represent that you are authorized to accept these terms on its behalf and to legally bind that entity to this Agreement.

2. Privacy Policy and Account Security

Privacy: We are committed to notifying you how we collect and use your data. Please refer to our Privacy Policy (which may be updated periodically) to understand how we handle personally identifying information collected from the Site.
Contact Consent: By submitting forms or providing information, you acknowledge an established business relationship and expressly consent to be contacted by us or our service providers via phone, email, text, or otherwise.
Account Responsibility: If required to create an account, you must provide accurate, complete, and updated information and are responsible for maintaining the security of your password. You are solely responsible for all activity associated with your account, whether authorized or not.
Public Areas: You are solely responsible for any information, content, or material you upload or post to any “Public Area” (such as a forum or message board). If you believe illegal conduct is occurring, contact local law enforcement immediately.

3. Site Operation and Data Accuracy

Operation: The specific features and functionality of the Site are dynamic and subject to change at our sole discretion. We reserve the right to withdraw, suspend, or discontinue any feature of the Site at any time without liability to you.

4. Intellectual Property and Permitted Use

Proprietary Rights: The content, structure, “look and feel,” and all other elements of the Site are protected by copyright and other intellectual property laws. Submissions (Ideas, Suggestions): Any unsolicited materials (suggestions, ideas, comments, etc.) submitted to us are deemed non-confidential. We will own exclusive rights, including all intellectual property rights, and will be entitled to unrestricted use of such submissions for any purpose without compensation to you.
User Content (Your Posts): If we permit you to post content (“User Content”), you grant us a worldwide, perpetual, royalty-free license to use, copy, display, and create derivative works of that content on or through the Site. You are solely responsible for all User Content you make available and warrant that it does not infringe on any third party’s rights or violate any law.

6. Third-Party Content and Disclaimers

Third-Party Content: The Site may display links or content from third parties (including advertisements or external properties). This display does not constitute our sponsorship, endorsement, or recommendation. Your interaction with any third party accessed through the Site is at your own risk. We are not responsible for any injury, damages, or negative experiences resulting from third-party websites or services.
DISCLAIMER OF WARRANTIES: ACCESS TO AND USE OF THE SITE AND SITE MATERIALS ARE AT YOUR SOLE RISK. THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING loss of profits or data) arising from or in connection with the Site, Site Materials, or services offered, even if advised of the possibility of such damages. If monetary damages are awarded, they shall not exceed one hundred U.S. dollars ($100).

7. General Provisions

Indemnity: You agree to **indemnify and hold us harmless** from and against all claims, lawsuits, damages, liabilities, and costs arising from or relating to your breach of this Agreement or your use of the Site.
Termination: We may, in our sole discretion and without prior notice, **terminate your access** to or use of the Site at any time and for any reason.
Dispute Resolution: You agree to an **Initial Dispute Resolution Process** to resolve issues cost-effectively. You also agree to a **Class Action Waiver** and **Waiver of Jury Trial** for any disputes resolved through litigation.
